1. All vehicles, boats and other assets

(a) To assist with the identification and control of estate members’ assets, all vehicles will be required to have their identification stickers on as prescribed by the estate.

(b) Should any vehicles or assets that require identification (such as boats and golf carts) in terms of the estate rules and guidelines not be clearly identifiable, it will be retained until the owner can confirm proof of ownership.

(c) Services (such as the tractors) will only be available to estate members with the official identification stickers.

(d) All official identification stickers, on request and annually renewed, are available at the estate office for purchase in line with the estate approved pricing per vehicle.

(e) The estate office holds a record of all the assets with identification stickers to assist with security control at the gate and for record keeping purposes.

(f) Penalties for vehicles not identified in terms of estate regulation.

2. Golf carts – Under-age drivers and estate indemnities

(a) Where the driver is a person below the legal age limit i.e. the driver does not have a drivers licence.

(b) HOWEVER even if a valid licence is not so required, the Board of Directors will not permit

        • any person under 18 years of age to drive or be in control of a golf cart on the Estate under any circumstances;  nor
        • any other person to drive or be in control of  a golf cart on the Estate unless the Board of  Directors is in possession of a written release and indemnity, in the form required by the Board, from the member owning such golf cart exonerating the Homeowners Association, its Directors, officials, employees and contractors from any liability of whatsoever nature arising directly or indirectly from the possession or use or enjoyment of such golf cart whether by such member or anyone else possessing, using or enjoying it with his general knowledge and consent, and indemnifying them against all and any claims, demands, suits at law and all and any  liability arising directly or indirectly from the possession or use or enjoyment of such golf cart so arising, made or brought against them or any of them by any third party.

After receipt of such release and indemnity a special STICKER identifying both cart and owner member will be issued to the owner member. This MUST be attached to the golf cart in the FRONT and in the middle of the golf cart body itself. Failure to display the sticker will be a   breach of the rules and will attract a penalty in terms of the rules governing the use of Golf       Carts on the Estate and could in the event of repeated penalties being imposed, result in the member concerned being banned from using the golf cart. “

In case of any violation of the above, i.e. where the driver of the golf cart is under the age of 18 and no sticker indicating the indemnity is displayed on the golf cart, Security will confiscate  the golf cart and only the owner will be able to collect the golf cart from Security. A penalty of R10000 will be levied to the owner.

PENALTY - R1000.00

3. Rules and Regulations governing all motor bikes, quad bikes and other such motorised vehicles making use of petrol engines

(a)The use of quad bikes on the estate is prohibited.

(b) All motorised vehicles must be driven from the unit / storage area to the intended destinations in an orderly fashion (no / low noise). Any excessive noise will result in penalties.

PENALTY - R500.00

4. Pets

(a) All owners of Pets on the estate must provide details of their animals to the estate office for recognition and registration to assist in controlling pets. Any pets identified that are not registered will be removed from the estate

(b) All owners with registered pets that are not complying with the rules – such as not having their dogs leashed when they take them for a walk, will be fined.

PENALTY - R500.00

5. Marina

(a) To protect estate members and to avoid the violation of safety regulations in the harbour area, no refuelling of water craft in the harbour area will be allowed. Should this measure be ignored, the vessel will be removed and the owner fined.

(b) NO-WAKE zone in the harbour area – should the no-wake zone in the harbour area be ignored, the vessel will be removed and the owner fined.

PENALTY - R500.00

6. Conduct, respect and lifestyle

(a) General misconduct will not be tolerated towards any of the estate staff, its assets, suppliers or service providers. Should a formal complaint be lodged with regards to such unruly behaviour, disciplinary measures will be taken by the Disciplinary Committee as they deem fit.

(b) Any physical misconduct or assault will have ZERO tolerance and will be addressed by CBC’s security force (ADT) in accordance with all of their authorised protective and regulated measures. Should it be required, a case of assault will be lodged with the Police and a criminal record registered against the owners / perpetrators.

(c) ANY misconduct on ANY nature affecting the golf course and or its greens - either tampering with, driving on or over the greens – will be for the account of the perpetrators. The cost to re-instate a damage green could be as much as R200 000. The owner associated with or implicated (if their guests etc.) will receive an additional penalty of R10000.00
