Authorised Procedures
- Fidelity security will be responsible for applying the rules, discipline and where necessary, issue
- Fines and penalties where they cannot find a solution to a problem.
- Warnings will be given before fines are issued – Management is not out to earn money, irritate owners or create issues. Management has, on request from concerned residents, react and have implemented pro-active measures to ensure safety to owners, visitors and other stakeholders and to protect everyone’s assets. iv. The fines list will be available for review should it be needed at the CBC office. It will be a list signed by all the directors – approving the fine values.
Administration & Objections
- Fidelity security guards will be carrying a penalty / fines book with them where they will record all the fines issued against the owners in their official registers at the guardhouse after a shift.
- Fidelity security guards cannot be bribed – they will be dismissed if they accept bribes. They are tested by various methods to ensure their compliance and to avoid possible conflict and poor conduct. Should an individual attempt to bribe the guards, they will be reported and disciplinary steps will be taken (apart from the fine)
- The CBC staff and administration office are not involved in any application, administration or opinion around the actual events and associated reality. They cannot influence the outcome nor “squash” a fine.
Penalty / Fine Recovery
- The list of fines and penalties recorded by the Fidelity security guards against the registered asset owners will be collected each month with the levies.
- The amounts will be based on the signed documents as presented by the guards, describing the incident in full detail – as they would a security report.
- Any appeals can be done in writing to the Disciplinary Committee.
- The penalty is a recovery as instructed under the normal rules and regulations of the estate as approved and instructed by the members at the AGM.
- Any non-payment of the penalties will be dealt with under the normal procedure for non-payment of levies / late payments. Such legal and other recovery costs will be, as authorised under the CBC rules, for the account of the owner as well.
